Acceptance of Terms
By accessing or using the Bhavnika Pvt. Ltd. platform — including our website, mobile application, and any related services (collectively, the "Platform") — you confirm that you have read, understood, and agree to be legally bound by these Terms and Conditions ("Terms"), our Privacy Policy, and all applicable laws and regulations of India.
If you are using the Platform on behalf of a business, organisation, or other legal entity, you represent that you have the authority to bind that entity to these Terms, and "you" refers to both you individually and that entity.
Eligibility
To register and use Bhavnika Pvt. Ltd., you must meet all of the following criteria:
- You must be at least 18 years of age. Minors may only use the Platform under the direct supervision of a parent or legal guardian who accepts these Terms on their behalf.
- You must be a resident of India or an entity incorporated under Indian law (unless otherwise permitted by Bhavnika Pvt. Ltd. in writing).
- You must not have been previously suspended or removed from Bhavnika Pvt. Ltd. or any related platform operated by us.
- Your use of the Platform must not violate any applicable law, regulation, order, or directive issued by any governmental authority in India.
Account Registration & Security
To access most features of the Platform, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration, including your legal name, valid mobile number, and email address.
- Keep your account information up to date at all times.
- Maintain the confidentiality of your password and not share your login credentials with any third party.
- Notify Bhavnika Pvt. Ltd. immediately at bhavnika2022@gmail.com if you suspect any unauthorised access to your account.
- Accept full responsibility for all activities conducted under your account, whether or not authorised by you.
Bhavnika Pvt. Ltd. reserves the right to verify your identity using OTP verification, Aadhaar-based KYC, or other means, particularly for high-value listings or suspicious account activity.
Marketplace Rules & Listing Standards
Bhavnika Pvt. Ltd. is a platform that connects buyers and sellers. We do not buy, sell, or own any listed items. The following rules apply to all listings posted on the Platform:
- Accuracy: All listing details — including title, description, price, location, photographs, and condition — must be truthful and not misleading.
- Ownership: You must own or have legal authority to sell the item you list. Listing stolen goods or goods to which you have no title is a criminal offence.
- Price: Prices must be stated in Indian Rupees (INR). Hidden charges or bait-and-switch pricing are prohibited.
- One listing per item: Duplicate listings for the same item are not permitted and will be removed.
- Category accuracy: Items must be listed in the correct category. Misclassification to gain visibility is a policy violation.
- Photos: Listings must include clear, original photographs of the actual item. Stock photos or images from the internet are not permitted for used items.
- Availability: Sold or unavailable items must be marked as sold or removed promptly.
Prohibited Items & Conduct
The following categories of items may not be listed, offered, or sold on Bhavnika Pvt. Ltd. under any circumstances:

- Licensed pets (where legal)
- Services: tutoring, repair, freelance
🚫 Strictly prohibited items
- Firearms, ammunition, explosives
- Narcotics, drugs, or controlled substances
- Counterfeit or replica goods
- Pirated software, media, or content
- Human organs, blood, or body parts
- Stolen property of any kind
- Lottery tickets, gambling services
- Endangered wildlife or protected items
Prohibited conduct includes but is not limited to:
- Sending unsolicited commercial messages or spam to other users.
- Harassing, threatening, or abusing any user, Bhavnika Pvt. Ltd. employee, or support agent.
- Attempting to circumvent the Platform (e.g., directing buyers/sellers to external channels to avoid fees).
- Manipulating search results through keyword stuffing or false categorisation.
- Using automated bots, scrapers, or scripts to access or extract data from the Platform.
- Impersonating Bhavnika Pvt. Ltd., its staff, or any other person or entity.
If any listing description, title, image, or media is generated, modified, or altered using Artificial Intelligence (AI) or synthetic tools, you must disclose this fact at the time of creation by enabling the "AI-Generated" label on the Platform.
Uploading AI-generated content (including synthetic model photography, deepfakes, or voice-altered media) that depicts real people without their explicit consent, or misrepresents goods, is strictly prohibited. Failure to disclose SGI will result in immediate content removal and account termination.
Seller Obligations
As a seller on Bhavnika Pvt. Ltd., you specifically agree to:
- Describe items honestly and disclose all known defects, damage, or limitations.
- Respond to buyer enquiries within a reasonable time (we recommend within 24 hours).
- Honour agreed prices and not change them after accepting a buyer's interest.
- Complete transactions that you have confirmed directly with the buyer.
- Comply with the Consumer Protection Act, 2019, including providing accurate information about goods and services.
- Remove listings promptly once an item is sold or no longer available.
Buyer Obligations
As a buyer on Bhavnika Pvt. Ltd., you agree to:
- Conduct due diligence before purchasing — inspect items personally where possible, especially for high-value goods like vehicles and electronics.
- Honour offers or commitments you make to sellers.
- Not engage in bad-faith negotiations, price manipulation, or harassment of sellers.
- Meet sellers in safe, public locations for in-person transactions. Avoid sharing your home address with strangers.
- Settle payment directly with the seller. Bhavnika Pvt. Ltd. is not involved in any financial transaction between buyers and sellers.
- Report any fraudulent listing or suspicious seller activity to Bhavnika Pvt. Ltd. immediately.
Fraud Prevention & Platform Safety
Bhavnika Pvt. Ltd. takes fraud very seriously. We have implemented systems to detect and prevent fraudulent activity. You agree to assist our efforts by:
- Reporting any user you suspect of fraud, misrepresentation, or prohibited activity using the in-app "Report" function.
- Never transferring money to a stranger before physically inspecting the item in person.
- Being alert to common scam patterns such as requests to pay in advance without seeing the item, or requests to communicate outside the Platform.
- Verifying the identity of the other party before meeting for a transaction.
Bhavnika Pvt. Ltd. will never ask you for your OTP, PIN, CVV, or banking password via call, SMS, or email. Bhavnika Pvt. Ltd. has no payment system and will never request money transfers of any kind. If you receive such a request from someone claiming to be Bhavnika Pvt. Ltd., report it immediately at bhavnika2022@gmail.com.
Intellectual Property
The Bhavnika Pvt. Ltd. name, logo, design, software, databases, and all content created by Bhavnika Pvt. Ltd. (collectively, "Bhavnika Pvt. Ltd. Content") are owned by Bhavnika Pvt. Ltd. and are protected by intellectual property laws including the Copyright Act, 1957, and the Trade Marks Act, 1999.
You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Platform strictly for its intended purpose. You may not:
- Copy, reproduce, modify, or distribute any Bhavnika Pvt. Ltd. Content without prior written consent.
- Use Bhavnika Pvt. Ltd.'s trademarks, logos, or branding in any manner that suggests endorsement or affiliation.
- Reverse-engineer, decompile, or disassemble any part of the Platform's software.
- Scrape, crawl, or extract data from the Platform using automated tools.
By posting content (images, text, descriptions) on the Platform, you grant Bhavnika Pvt. Ltd. a worldwide, royalty-free, non-exclusive licence to use, reproduce, and display that content for the purpose of operating and promoting the Platform. You represent that you own or have the necessary rights to the content you post.
Privacy & Data Collection
Bhavnika Pvt. Ltd. collects, processes, and stores personal data in accordance with the Digital Personal Data Protection Act, 2023 (DPDP Act), the DPDP Rules, 2025, and our Privacy Policy.
Your consent for processing personal data must be free, specific, informed, unconditional, and unambiguous, provided via an affirmative action (such as checking a box during registration). You have the right to withdraw your consent at any time as easily as it was given, by contacting us at bhavnika2022@gmail.com. Upon withdrawal, we will cease processing and delete your data within 30 days, unless required by law.
A comprehensive privacy notice is available in English and scheduled Indian languages (including Hindi and Gujarati) based on your preference during account setup.
Key data practices:
- We collect your name, phone number, email, device data, location, and transaction history to operate the Platform.
- Your phone number may be partially masked in public listings for your protection.
- We may share your data with law enforcement authorities when required by a valid court order or statutory obligation.
- You have the right to access, correct, and request deletion of your personal data by contacting bhavnika2022@gmail.com.
- We do not sell your personal data to third-party advertisers.
Disclaimers & Limitation of Liability
Bhavnika Pvt. Ltd. is a technology platform and is not a party to any transaction between buyers and sellers. Accordingly:
- Bhavnika Pvt. Ltd. makes no representations or warranties regarding the quality, safety, legality, or accuracy of any listing, product, or service offered on the Platform.
- Bhavnika Pvt. Ltd. is not responsible for the conduct of any user, whether online or offline.
- Bhavnika Pvt. Ltd. does not guarantee the continuous, uninterrupted, or error-free availability of the Platform.
- To the maximum extent permitted by applicable law, Bhavnika Pvt. Ltd.'s total aggregate liability to any user shall not exceed the fees paid by that user to Bhavnika Pvt. Ltd. in the 3 months preceding the event giving rise to the claim.
Account Suspension & Termination
Bhavnika Pvt. Ltd. reserves the right to suspend, restrict, or permanently terminate your account at any time, with or without prior notice, if we determine that you have:
- Violated any provision of these Terms or any applicable law.
- Engaged in fraudulent, deceptive, or harmful conduct on or through the Platform.
- Listed prohibited items or engaged in prohibited conduct.
- Received multiple verified complaints from other users.
- Created multiple accounts to evade enforcement actions.
- Attempted to harm, compromise, or exploit the Platform's technical infrastructure.
Upon termination, your right to use the Platform ceases immediately. Content you have posted may be removed at Bhavnika Pvt. Ltd.'s discretion. You may appeal a suspension by writing to bhavnika2022@gmail.com within 30 days, providing relevant details.
Dispute Resolution
In the event of any dispute between users, Bhavnika Pvt. Ltd. encourages direct resolution. If unresolved, you may contact our support team who will attempt to facilitate an amicable settlement.
For disputes between you and Bhavnika Pvt. Ltd., the following process applies:
- Step 1 — Internal Resolution & Grievance Timelines: Raise a formal complaint at bhavnika2022@gmail.com.
- Acknowledgment: All complaints will be acknowledged by our Grievance Officer within 24 hours.
- General Grievances: Resolved within 15 days.
- Synthetically Generated Information (SGI) & Impersonation: Complaints regarding undisclosed SGI or impersonation will be resolved within 36 hours.
- Urgent Government Takedowns: Any illegal content notified by a court order or appropriate government authority will be disabled or removed within 3 hours.
- Non-consensual Nudity & Deepfakes: Access to non-consensual deepfakes, nudity, or sexually explicit depictions will be disabled or removed within 2 hours of a complaint.
- Step 2 — Mediation: If unresolved, either party may refer the dispute to a mutually agreed mediator under the Mediation Act, 2023.
- Step 3 — Arbitration: If mediation fails, disputes shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Ahmedabad, Gujarat, India, and proceedings shall be in English.
Notwithstanding the above, either party may seek urgent injunctive or equitable relief from a competent court of law.
Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of India, including but not limited to:
- The Information Technology Act, 2000 and Rules thereunder
- The Consumer Protection Act, 2019
- The Indian Contract Act, 1872
- The Digital Personal Data Protection Act, 2023
Subject to the arbitration clause above, all disputes shall be subject to the exclusive jurisdiction of the competent courts located in Ahmedabad, Gujarat, India.
Changes to These Terms
Bhavnika Pvt. Ltd. may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. When we make material changes, we will:
- Notify registered users via email and in-app notification at least 15 days before the changes take effect (or as required by law).
- Update the "Effective Date" at the top of this page.
- Maintain an archive of previous versions accessible at terms.bhavnika2022@gmail.com/history.
Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Platform and may close your account.
